Back cover:
These four essays are all within the traditional field of information
technology law. They were initially written as a part of the authors LLM in
Computer and Information Technology Law at University of Strathclyde.
The essay on intellectual property right is concerned with the interaction
between (especially) copyright and the competition law of the EC. In the
question of antagonism or peaceful cooperation the author is arguing that
there is a peaceful cooperation in the field.
The essay on privacy and data protection deals with the underlying problems
and the need for data protection. To some extent the European dimension is
discussed.
The essay on information crime has its starting point in the problems with
applying traditional (or existing) criminal offences to information. The
problems inherent in the fact that information, per se, is not an “ordinary”
moveable is a major part of the discussion. A brief discussion de lege lata
and de lege ferenda on the problems of theft of information is also included.
The final essay on liability deals with the problem of software and the
Product Liability directive. The question of whether software is subject
matter of product liability is unfortunately unclear.
